If there is existing access to the land from the highway do I need to enter into an agreement to continue the access?

It is not possible to answer this question without further information. In most instances there will be a need to alter the existing access in which case there will be a need to enter into an agreement. Equally there may be a need to stop up and raise the kerbs to the existing entrance as well as constructing a new one nearby. Each case has to be dealt with on an individual basis.
