Are developments of all sizes dealt with in the same way?

No - There are two distinct processes used to deal with highway aspects of developments. These are known as Minor Works Section 278 and Full Section 278. The reason for having two processes is derived from the impact the development will have on the highway and highway users.

If the development has less than 40 parking spaces it is dealt with as a Minor Works Section 278.

If the application involves more than 40 parking spaces it is dealt with in a much more technical manner and is checked against National Design Standard criteria. These larger developments usually involve transfer of land between the developer and the Council and the formal adoption of the new highway within a site.
