The statutory public Register of Judgments, Orders and Fines for England and Wales, is maintained by Registry Trust Ltd on behalf of the Ministry of Justice.
Section 1: money judgments and administration orders made in county courts, child support agency liability orders made in magistrates' court, over past 6 years.
Since April 2006, the Register has included details of:
Section 2: high court money judgments.
Section 3: fines defaults registered in magistrates' court.
Registry Trust Ltd also hold public registers for money debts recorded in Scotland, Isle of Man, Northern Ireland, Jersey and Eire. A Guernsey register will shortly be added.
In line with data protection requirements, when judgments/decree data is processed for jurisdictions other than England and Wales, notification letters are sent to debtors.
Unless set-aside/cancelled by the courts, or evidence provided that the debt was fully paid within 1 calendar month, details are held for a period of 6 years from the registration date except for Fines Defaults that are held for 5 years from the date of conviction.
To find out if an individual or an organisation has money debts recorded on any section of the E & W Register or any other registers, searches can be made:
- on-line, payable by credit or debit card)
- by written application (forms may be printed from the website)
The fee for a search of each section of the E & W Register or for each of the public registers is £8.00 per named person for firm at a stated address, or limited company name (cheque/postal orders payable to Registry Trust Ltd). Fees for the same search against other registers, or any combination of other registers and section(s) of the E & W Register:
2 searches £16.00; 3 searches £20.00; 4 searches £25.00; 5 or more £30.00.
The search result will include: name and address of person/firm, or name of limted company, against whom search made; date and amount of debt; court name and case number; date of satisfaction (if available); or will be advised that no debts are registered.
Details of judgments are passed to the credit reference agencies for inclusion in their files and will have an effect on the debtor's ability to obtain credit facilities.
